In this case we had copies of the tax transcripts on file and Attorney Charles Kinzer brought the transcripts all the way from our office on Monroe to the Trustee's office so that the meeting could be held.

Client also owns a vacant lot next to her home. The mortgage documents are unclear as to whether it is covered by her current mortgage. The Trustee requested documents after her 341. After a timely response and document review, the Trustee has decided to not pursue any of the client's assets. She should receive her discharge in a few weeks.

Instead of blindly scanning the returns, I looked and saw that they listed only his wife Mary, and that the filing status claimed was Head of Household. "Why didn't you file together, William? Were you separated?" I asked. "No, we lived together all year, but I didn't earn any money that year!"... I explained that not only is it incorrect to claim Head of Household if you're married, and not "considered unmarried" (separated more than six months), you're actually worse off than filing Married Filing Jointly! Told him to take this to a tax professional to be sure, but that changing your filing status, getting the additional deduction/exemption and reduced tax rate SHOULD result in another $1,600 or so added to your refund! As this case is under median, this will also result in additional funds for gucs we can claim later, and the client will keep an extra $800! First refund after CF so couldn't adjust w/h to avoid getting refund. (JJB has advised them to do for future years).

By spending the extra time discussing everything that was new we discovered that by filing a new case we could stop a sheriff sale on real estate that he'd previously wanted to let go. The new case is now filed, his sheriff sale was stopped and he's on his way to catching up on all of his mortgage arrears because I made sure to have a detailed conversation with him about his entire life, not just the basic facts.

She tried calling them back several times, but wasn't able to get a hold of them. She was worried they charged her card without providing her with any services. I contacted Sage on behalf of the client and verified a payment didn't go through and that there was no pending payment. I then contacted Hananwill and scheduled the client to complete the course tomorrow at 6pm, a time convenient for her. I walked her through the steps on how to complete the course over the phone and wrote the instructions on a piece of paper to take home with her. She left the office feeling much more relaxed and very appreciative for my help.

So.....not only did I point out for them the portion of PFG's DVD presentation that references the Bible and 'release', I looked it up for them and gave them the exact passage, which is, as PFG knows, from Deuteronomy 15:1.......... "At the end of every seven years you shall grant a release. And this is the manner of the release: every creditor shall release what he has lent to his neighbor. He shall not exact it of his neighbor, his brother, because the Lord's release has been proclaimed. Of a foreigner you may exact it, but whatever of yours is with your brother your hand shall release. But there will be no poor among you; for the Lord will bless you in the land that the Lord your God is giving you for an inheritance to possess— if only you will strictly obey the voice of the Lord your God, being careful to do all this commandment that I command you today. ... Must have done the trick for them. They not only signed up with us but they came back 3 days later and gave me all 2k we need for CF. Nice!

Explained what that buys her: many creditors laugh at these offers (Discover and AmEx especially), cannot include medical, mortgage arrears or vehicles, AND you will get a 1099 for any "settled" debt that may increase your tax liability to the IRS. In a 13: for less than half, I can eliminate ALL of your unsecured debt for less per month. Additionally I will be here in a year versus any supposed debt settlement company. Convinced, we cancelled her debt consolidation via fax and I helped her fill out the complaint form w/ the Illinois Attorney General.

I explained why the client fell behind to the judge and the judge agreed to give the client a long continuance to get current even though the Mortgage Company refused. Now, the client will get to keep the home under bankruptcy protection by getting current on payments.
